These Terms of Service constitute a legally binding agreement between you and SKATE AU PTY LTD (ACN 699 854 914), a proprietary company registered in New South Wales, Australia, trading as skate (“we”, “us”, “our”). By accessing or using our website at skete.studio and purchasing products from us, you agree to be bound by these Terms.

3. Orders and Acceptance

• All prices on the Website are listed in Australian Dollars (AUD) and include Goods and Services Tax (GST) where applicable under A New Tax System (Goods and Services Tax) Act 1999 (Cth).
• Placing an order constitutes an offer to purchase. An order is accepted only when we dispatch the Products and send you a shipping confirmation email.
• We reserve the right to refuse or cancel any order at our sole discretion, including (but not limited to) where there has been a pricing error, the product is out of stock, or payment cannot be verified.
• If we cancel an order after payment has been processed, we will issue a full refund to your original payment method within 7 business days.

4. Pricing and Payment

• Prices are subject to change without notice. The price charged is the price displayed at the time your order is confirmed.
• We accept payment via Visa, Mastercard, American Express, Apple Pay, Google Pay, and PayPal. All card payments are processed securely through Stripe, Inc., a PCI-DSS Level 1 certified payment gateway. We do not store or have access to your full credit card details.
• By providing your payment information, you represent and warrant that you are authorised to use the payment method and that the information provided is accurate.
• For international orders, your bank or card issuer may charge additional currency conversion fees. These fees are your responsibility.

5. Shipping and Delivery

• We ship worldwide from Sydney, Australia. Shipping times and costs are set out in our Shipping & Returns policy.
• Title and risk of loss pass to you upon delivery of the Products to the shipping carrier. We are not responsible for delays caused by customs clearance, postal services, or events beyond our reasonable control.
• International customers are responsible for any customs duties, import taxes, or other charges imposed by the destination country.

6. Returns and Refunds

• Our returns and refunds policy is governed by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)).
• You may return unworn, unwashed Products in their original condition within 28 days of delivery for a refund or exchange. See our Shipping & Returns page for full details.
• If a Product is faulty, not of acceptable quality, or does not match its description, you are entitled to a remedy under Australian Consumer Law, which may include a refund, repair, or replacement.

7. Consumer Guarantees

Our Products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any reasonably foreseeable loss or damage. You are also entitled to have the Products repaired or replaced if the Products fail to be of acceptable quality and the failure does not amount to a major failure.

8. Intellectual Property

• All content on the Website, including text, images, logos, product descriptions, and designs, is the intellectual property of SKATE AU PTY LTD or its licensors and is protected by Australian and international copyright and trademark laws.
• You may not reproduce, distribute, modify, or create derivative works from any content on the Website without our prior written consent.

9. Limitation of Liability

To the fullest extent permitted by Australian law, SKATE AU PTY LTD shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Website or purchase of our Products, except where such liability cannot be excluded under the Australian Consumer Law.

Our total liability to you for any claim arising under these Terms or in connection with the purchase of Products is limited to the purchase price of the relevant Product(s).

10. Force Majeure

We shall not be liable for any delay or failure to perform our obligations under these Terms where such delay or failure results from circumstances beyond our reasonable control, including (but not limited to) acts of God, natural disasters, pandemic, war, terrorism, governmental restrictions, labour disputes, or disruptions to postal or shipping services.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this page. Continued use of the Website following any changes constitutes acceptance of the revised Terms.
